Welcome to Mecsil Tools LLC. These Terms of Service (“Terms”) govern your access to and use of mecsil.tools, including purchases made directly through our website and your use of content, services, features, and customer-support resources provided by Mecsil Tools LLC.

By accessing our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms and to the policies referenced below.

If you do not agree to these Terms, please do not use our website or services.

These Terms should be read together with the following Mecsil Tools policies, which are incorporated into these Terms where applicable:

If a specific policy contains more detailed terms applicable to a particular transaction or issue, that specific policy will govern that matter.

Orders placed through third-party marketplaces may also be subject to mandatory marketplace terms and buyer-protection rules as described below.

3. Eligibility

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to make purchases through Mecsil Tools.

By placing an order, you represent that:

  • You have legal capacity to enter into the transaction;

  • The information provided is accurate;

  • You are authorized to use the payment method submitted; and

  • Your purchase and intended use of the product comply with applicable law.

4. Products and Professional Equipment

Mecsil Tools sells professional tools, equipment, replacement parts, accessories, and related products, including equipment intended for telecom, fiber, utility, construction, and other professional applications.

Certain Mecsil products are intended for use by trained or experienced personnel.

Customers are responsible for:

  • Selecting products appropriate for their intended application;

  • Reading and following applicable product instructions;

  • Operating products safely;

  • Performing required inspection and maintenance; and

  • Complying with applicable workplace, jobsite, safety, and regulatory requirements.

Product specifications, dimensions, materials, compatibility information, images, and descriptions are provided to assist customers in making purchasing decisions.

We make reasonable efforts to keep this information accurate. However, minor manufacturing changes, production revisions, photography, lighting, display settings, or other factors may result in differences between images and the delivered product that do not materially affect functionality.

5. Product Availability

Products are subject to availability.

Mecsil Tools may:

  • Limit quantities;

  • Discontinue products;

  • Modify product configurations;

  • Update specifications;

  • Correct inventory errors; or

  • Cancel orders when inventory is unavailable.

Inventory displayed on the website may change before an order is completed.

6. Orders and Order Acceptance

Submitting an order does not necessarily constitute final acceptance by Mecsil Tools.

We may review orders for:

  • Product availability;

  • Payment authorization;

  • Pricing or listing errors;

  • Fraud prevention;

  • Shipping restrictions;

  • Export restrictions;

  • Suspected resale abuse; or

  • Other legitimate business reasons.

An order may be refused or canceled when reasonably necessary.

If Mecsil Tools cancels a paid order before fulfillment, the applicable payment will be refunded according to the original payment method and payment-processing rules.

7. Pricing

Unless otherwise stated, prices displayed on mecsil.tools are in U.S. Dollars (USD).

Prices may change without notice before an order is placed.

Applicable:

  • Sales taxes;

  • Duties;

  • Import charges; and

  • Shipping charges not covered by an applicable free-shipping offer

will be displayed or handled according to the checkout terms applicable to the order.

Mecsil Tools currently offers qualifying Free Standard Shipping within the 48 contiguous United States as described in our Shipping Policy.

The full Shipping Policy governs eligibility, geographic limitations, carrier services, and expedited shipping options.

8. Pricing or Listing Errors

We make reasonable efforts to ensure that product prices and information are accurate.

If a product is listed with an incorrect price, specification, quantity, or other material error, Mecsil Tools may correct the error and, where necessary, cancel the affected order.

If payment has already been collected for an order that is canceled because of a material listing or pricing error, the applicable amount will be refunded.

9. Payment

Orders placed directly through mecsil.tools are processed using payment systems available through Shopify and other authorized payment providers.

Available methods may include, depending on eligibility and checkout configuration:

  • Shop Pay;

  • Visa;

  • Mastercard;

  • American Express;

  • Discover;

  • Apple Pay;

  • Google Pay;

  • PayPal; and

  • Other payment methods made available through Shopify or authorized payment providers.

Available payment options may change over time.

Mecsil Tools does not independently store complete payment-card information when the transaction is processed through Shopify Payments or another authorized payment provider.

10. Payment Authorization

By submitting payment information, you represent that:

  • The payment information is accurate;

  • You are authorized to use the payment method;

  • Charges associated with the order are authorized; and

  • You will not initiate an improper payment dispute or chargeback for a valid transaction.

Suspected fraudulent transactions may be canceled or held for additional verification.

Nothing in this section limits lawful chargeback, consumer-protection, or marketplace rights.

11. Shipping and Delivery

Shipping terms are governed by the current Mecsil Tools Shipping Policy.

For direct orders on mecsil.tools, Mecsil Tools uses UPS as its primary carrier.

Eligible standard orders delivered within the 48 contiguous United States may receive Free Standard Shipping using UPS Ground® or UPS® Ground Saver, according to the Shipping Policy.

Customers may select faster UPS services when available and pay the applicable expedited shipping cost.

Orders are generally processed within 1 business day after payment confirmation, subject to product availability and any specific commitment displayed for the order.

12. Delivery Estimates and Carrier Delays

Estimated delivery dates are estimates unless expressly identified as guaranteed by the carrier or applicable marketplace.

Delivery may be affected by circumstances including:

  • Weather;

  • Carrier network disruptions;

  • Peak shipping volume;

  • Incorrect addresses;

  • Customs processing;

  • Transportation interruptions; or

  • Events outside Mecsil Tools' reasonable control.

Mecsil Tools remains responsible for fulfilling its stated handling commitment and assisting customers with legitimate shipping issues when appropriate.

13. Lost, Missing, or Delivery-Related Issues

Customers should contact Mecsil Tools promptly if tracking indicates a delivery problem, if a package is missing, or if an order arrives damaged.

Claims will be reviewed based on:

  • Carrier tracking;

  • Delivery documentation;

  • Customer information;

  • Shipping records;

  • Applicable law; and

  • Any marketplace buyer-protection requirements.

A tracking status alone does not eliminate rights that may exist under applicable law, carrier procedures, or marketplace buyer-protection programs.

14. Returns and Refunds

Returns are governed by the current Mecsil Tools Return & Refund Policy.

Eligible unused products purchased directly from Mecsil Tools may generally be returned within 30 calendar days after delivery, subject to the conditions in that policy.

Products that have been:

  • Installed;

  • Operated;

  • Used on a jobsite;

  • Modified;

  • Disassembled; or

  • Subjected to field wear

generally do not qualify as standard unused-product returns.

Purchasing a product for temporary use, project completion, evaluation under field conditions, or short-term jobsite use does not qualify the product for return as new or unused.

Defective-product and warranty claims are evaluated separately from standard buyer-remorse returns.

15. Return Shipping

For buyer-remorse returns, such as:

  • Change of mind;

  • Ordering the wrong product; or

  • No longer needing the item,

the customer is generally responsible for return shipping unless otherwise stated.

If Mecsil Tools sends an incorrect product or an item is confirmed to have an eligible defect or shipping-related problem, Mecsil Tools will provide the appropriate remedy in accordance with the applicable Return & Refund Policy, Warranty Policy, marketplace rules, and law.

16. Limited Warranty

Warranty coverage varies by product and model. Current MECSIL Cable Lasher warranty periods are 90 days for the Standard model, 180 days for the Pro model, and 1 year for the Heavy Duty model, subject to the terms, exclusions, and eligibility requirements described in our Limited Warranty Policy.

The warranty does not generally cover conditions such as:

  • Normal wear;

  • Improper operation;

  • Misuse or abuse;

  • Lack of required maintenance;

  • Accidental damage;

  • Unauthorized modification;

  • Improper installation; or

  • Operation outside the product's intended application.

The Limited Warranty is separate from the Return & Refund Policy and from any mandatory marketplace buyer-protection rights.

17. Safety and Proper Use

Customers are responsible for using products in accordance with:

  • Product instructions;

  • Safety warnings;

  • Proper industry practices;

  • Applicable jobsite procedures; and

  • Federal, state, local, or other applicable requirements.

The customer is responsible for ensuring that operators are appropriately trained and qualified for the equipment being used.

Mecsil Tools is not responsible for injury or property damage caused by misuse, unauthorized modification, improper maintenance, operation outside intended specifications, or disregard of applicable safety requirements, to the extent permitted by law.

18. Marketplace Orders

Mecsil Tools products may be promoted or sold through third-party channels including:

  • Amazon;

  • eBay;

  • Facebook / Meta;

  • Google Shopping;

  • Shop; and

  • Other authorized sales channels.

The rules applicable to an order depend on where the transaction is actually completed.

Orders Completed on Mecsil.tools

If a customer discovers a Mecsil product through Google Shopping, Facebook, Instagram, an advertisement, a search result, or another referral source but completes the checkout directly on mecsil.tools, the applicable Mecsil Tools policies govern the transaction.

Orders Completed Through a Marketplace

If the transaction is completed through Amazon, eBay, Meta, or another third-party marketplace, the marketplace's applicable:

  • Payment procedures;

  • Shipping commitments;

  • Return procedures;

  • Refund requirements;

  • Buyer protections;

  • Claims processes; and

  • Dispute procedures

may also apply.

Where a mandatory marketplace rule applicable to a specific order conflicts with a Mecsil Tools policy, the mandatory marketplace requirement will govern that marketplace transaction.

19. Amazon Orders

Amazon purchases should be managed through the applicable Amazon order system when required by Amazon.

Amazon-specific return, refund, payment, shipping, A-to-z Guarantee, or seller-fulfilled order requirements may apply independently of Mecsil Tools' direct-store policies.

20. eBay Orders

eBay purchases should be managed through the applicable eBay order and return system when required.

Applicable eBay rules, including the eBay Money Back Guarantee and seller obligations associated with the specific listing and transaction, may apply.

21. Facebook / Meta Orders

If a customer discovers a product through Facebook or Instagram but completes the order on mecsil.tools, the Mecsil Tools policies govern the direct transaction.

If a transaction is completed through a Meta-supported commerce or checkout process, the applicable Meta terms and buyer-protection requirements may also apply.

22. Google Shopping

Google Shopping may display or advertise Mecsil Tools products and policy information.

When Google Shopping directs a customer to mecsil.tools and the checkout is completed on the Mecsil Tools website, the transaction is a direct Mecsil Tools order and is governed by our policies.

If Google or another platform introduces or provides a transaction process with its own mandatory terms, those applicable terms may also apply to that transaction.

23. Third-Party Services

Our website may interact with services operated by third parties, including:

  • Shopify;

  • Payment providers;

  • Shipping carriers;

  • Analytics providers;

  • Advertising platforms;

  • Social-media platforms; and

  • Marketplace services.

Mecsil Tools does not control the availability, security, functionality, or independent policies of third-party services.

Use of those services may be subject to separate terms between the customer and the applicable provider.

24. Customer Accounts

Customers may have the ability to create or use an account to:

  • Review orders;

  • Track purchases;

  • Manage account information; or

  • Access other features.

Customers are responsible for maintaining the confidentiality of their credentials and for promptly notifying Mecsil Tools of suspected unauthorized access.

We may suspend access where reasonably necessary to protect customers, Mecsil Tools, or the security of the website.

25. Intellectual Property

Unless otherwise stated, content on the Mecsil Tools website, including:

  • Logos;

  • Product photography;

  • Technical illustrations;

  • Videos;

  • Manuals;

  • Product descriptions;

  • Graphics;

  • Website design;

  • Trademarks; and

  • Original written content

is owned by Mecsil Tools LLC, licensed to Mecsil Tools LLC, or used with permission.

Such content may be protected by copyright, trademark, trade-dress, and other intellectual-property laws.

No content may be reproduced, distributed, republished, sold, or commercially exploited without authorization except where permitted by law.

26. Permitted Use

Customers may use the Mecsil Tools website for legitimate:

  • Product research;

  • Purchasing;

  • Customer support;

  • Order management; and

  • Business-related purposes.

No ownership interest in the website or its intellectual property is transferred to users.

27. Prohibited Activities

You may not use the website or services to:

  • Commit fraud;

28. Fraud, Return Abuse, and Misrepresentation

Mecsil Tools reserves the right to review and, where legally permitted, reject or restrict transactions involving evidence of:

  • Fraud;

  • False claims;

  • Return abuse;

  • Product substitution;

  • Improper chargebacks;

  • Intentional product damage;

  • Misrepresentation of product condition; or

  • Attempts to return used equipment as new.

This provision does not restrict legitimate warranty claims, valid marketplace protections, lawful chargebacks, or statutory consumer rights.

29. Limitation of Liability

To the fullest extent permitted by applicable law, Mecsil Tools LLC and its affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the website or products where such damages may lawfully be excluded.

This may include loss of:

  • Profits;

  • Revenue;

  • Business opportunities;

  • Data; or

  • Business interruption.

To the fullest extent permitted by law, Mecsil Tools' aggregate liability arising from a particular product transaction will not exceed the amount paid to Mecsil Tools for the product or transaction giving rise to the claim.

However, nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights or remedies provided by applicable product-liability, consumer-protection, warranty, or other mandatory law.

30. No Limitation of Mandatory Rights

Nothing in these Terms is intended to waive or limit any right that cannot legally be waived.

Mandatory consumer protections, marketplace protections, statutory warranties, product-liability obligations, or other non-waivable legal rights remain applicable where required.

31. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Mecsil Tools LLC and its officers, employees, representatives, and affiliates from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the website;

  • Your violation of these Terms;

  • Your infringement of third-party rights; or

  • Your intentional misuse of Mecsil Tools products or services.

This provision does not apply where prohibited by law.

32. Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles, except where mandatory law requires otherwise.

33. Venue and Disputes

Unless applicable law or a mandatory marketplace dispute-resolution process requires otherwise, disputes relating to direct Mecsil Tools transactions or use of the Mecsil Tools website will be subject to the jurisdiction of the appropriate state or federal courts having jurisdiction in or over Madison County, Indiana.

Nothing in this section prevents:

  • Either party from pursuing an eligible small-claims action;

  • A customer from using mandatory marketplace dispute procedures;

  • A customer from exercising non-waivable statutory rights; or

  • Mecsil Tools and the customer from mutually agreeing to another dispute-resolution process.

These Terms do not impose mandatory binding arbitration.

34. International Customers

International purchases may be subject to:

  • Import duties;

  • Taxes;

  • Customs processing;

  • Brokerage fees;

  • Local product requirements; and

  • Local consumer-protection laws.

Where applicable law provides customers with rights that cannot lawfully be limited by these Terms, those rights will apply.

35. European Union and European Economic Area

Where applicable to qualifying consumer transactions in the European Union or European Economic Area, statutory consumer rights — including applicable withdrawal, conformity, and remedy rights — may apply independently of Mecsil Tools' standard policies.

Nothing in these Terms is intended to remove mandatory rights granted by applicable law.

36. Privacy

Collection and processing of personal information are governed by the Mecsil Tools Privacy Policy and applicable privacy law.

Customers should review that policy for information concerning:

  • Personal data;

  • Cookies;

  • Payments;

  • Analytics;

  • Advertising;

  • Customer communications; and

  • Third-party service providers.

37. Electronic Communications

By placing an order or contacting Mecsil Tools electronically, you consent to receive communications necessary to:

  • Confirm orders;

  • Process payments;

  • Provide shipping information;

  • Manage returns;

  • Handle warranty claims;

  • Provide customer support; and

  • Satisfy legal or transactional obligations.

The terms applicable to a completed order are generally those in effect when the order was placed, together with any mandatory legal or marketplace requirements applicable to that transaction.

39. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

40. No Waiver

Failure by Mecsil Tools to enforce a provision of these Terms does not constitute a permanent waiver of that provision or any other right.

41. Entire Agreement

These Terms, together with the applicable:

  • Shipping Policy;

  • Return & Refund Policy;

  • Limited Warranty Policy;

  • Secure Payments / Payment Policy;

  • Privacy Policy; and

  • Any terms specifically displayed for an order

constitute the agreement applicable to direct transactions with Mecsil Tools, subject to mandatory law and applicable marketplace requirements.
